Hirup-pikuk masalah negeri ini yang masih berjuang untuk keluar dari wabah virus corona ditambah dengan masalah sosial melandai masyarakat yang tak menentu, pekerjaan dan perekonomian terpengaruh. Pemerintah tidak peka melihat kondisi masyakarat, ditengah-tengah masyarakat dan pihak lainnya sedang berjuang melawan covid-19, pemerintah mala menerbitkan Perpres 64 tahun 2020 tentan kenaikan iuran BPJS ,Pemerintah seolah tak mematuhi Putusan Mahkamah Agung (MA) No.
7P/HUM/2020 yang membatalkan Pasal 34 Peraturan Presiden (Perpres) No.75 tahun 2019 tentang Perubahan atas Perpres No.82 Tahun 2018 tentang Jaminan Kesehatan terkait kenaikan iuran BPJS. Presiden Joko Widodo malah menerbitkan Perpres No. 64 Tahun 2020 yang bakal kembali menaikan iuran BPJS Kesehatan yang dinilai melanggar amanat putusan MA.

Perpres No. 64 Tahun 2020 tentang Perubahan Kedua atas Prepres No. 82 Tahun 2018 tentang Jaminan Kesehatan secara tidak langsung merupakan perbuatan melawan hukum, saya menilai Perpres tersebut kembali menaikkan iuran BPJS Kesehatan untuk kelas I dan Kelas II per 1 Juli 2020. Sementara iuran untuk kelas III akan dinaikkan pada tahun 2021. Menurut saya menaikkan kembali iuran BPJS Kesehatan tidak sejalan dengan Putusan MA yang telah membatalkan Perpres No. 75 Tahun 2019 yang menaikkan iuran BPJS Kesehatan, Pemerintah semestinya tak mengakali‟ publik dengan Perpres untuk menaikan lagi iuran BPJS yang telah dibatalkan MA ditambah lagi sekarang dalam pandemi corona.

“Seharusnya Pemerintah melaksanakan Putusan MA dengan taat asas dan lebih fokus dalam penanganan covid-19. Kalau seperti ini sama saja Pemerintah bermain-main dengan Putusan MA dan membuat masyarat semakin panik,”Perpres 64 Tahun 2020 itu mengatur skema iuran BPJS Kesehatan pasca MA membatalkan Pasal 34 Perpres No.75 Tahun 2019. Beleid itu menyebutkan besaran iuran peserta Pekerja Bukan Penerima Upah (PBPU) dan Bukan Pekerja (BP) sesuai manfaat (kelas) pelayanan ruang perawatan. Untuk Januari-Maret 2020 besar iuran mengikuti Perpres No.75 Tahun 2019 yaitu Rp160.000 (Kelas I); Rp110.000 (Kelas II); dan Rp42.000 (Kelas III).
Untuk April-Mei 2020 besaran iuran mengikuti amanat putusan MA yakni kembali ke tarif iuran sesuai Perpres No. 82 Tahun 2018 yakni Rp80.000 (Kelas I); Rp51.000 (Kelas II); dan Rp25.500 (Kelas III). Mulai Per 1 Juli 2020, iuran JKN-KIS bagi peserta PBPU dan BP disesuaikan menjadi Rp 150.000 untuk kelas I; Rp 100.000 untuk kelas II, dan Rp 42.000 untuk kelas III. Namun, khusus kelas III, pemerintah memberi bantuan iuran sebesar Rp16.500 pada 2020 dan menurun menjadi Rp7.000 per bulan pada 2021 mendatang,Pakar hukum tata negara dari Universitas Parahyangan, Asep Warlan Yusuf Mangatakan, Pasal 34 Perpres Nomor 64 Tahun 2020 rawan digugat oleh masyarakat. Sebab,pasal tersebut berisi kenaikan iuran BPJS Kesehatan yang sebelumnya telah dibatalkan Mahkamah Agun,Perpres 64 Tahun 2020 tidak dijelaskan faktor penyebab lenaikan iuaran BPJS Kesehatan hanya berisi narasi normatif dan klise tapi tidak menunjukan inti masalah.
Apa yang pemerintah lakukan sekang merupakan upaya untuk mencari eksistensi dan mencari simpati masyarakat ditengah-tengah wabah virus Covid-19, pikir saya pemerintah
tak seharusnya menerbitkan Pepres 64 tahun 2020 ini akan memicu protes dari masyarakat.

Pemerintah memang mematuhi putusan MA itu tapi hanya 3 bulan yakni April, Mei, dan Juni 2020. Setelah itu, iuran BPJS Kesehatan kembali dinaikkan lagi. Menariknya, iuran kelas III bakal dinaikan pada 2021 ini memiliki kesan hendak memberi pesan peduli terhadap masyarakat menengah ke bawah.Ini sangat mengkhawatir karena Perpres 64 tahun 2020 bakal ditentang masyarakat, dan mungkin masyarakat potensi menggugat kembali kenaikan iuran BPJS Kesehatan ke
MA. Kita berkaca pada uji materi Perpres 75 tahun 2019. Karena itu, seharusnya hal ini
menjadi pertimbangan pemerintah sebelum “melawan” MA melalui Perpres 64 tahun 2020.
